TERMS OF SERVICE

These Terms of Service ("Terms") govern the use of the GoBeyondo website and the provision of digital marketing and online presence services by GoBeyondo ("GoBeyondo", "we", "us", or "our") to business clients ("Client", "you", or "your").
By requesting our services, approving a quotation, Service Agreement, Order Confirmation, or other written proposal, or making payment for our services, you agree to be bound by these Terms.
1. Business-to-Business Services
GoBeyondo provides services exclusively to business clients, companies, entrepreneurs, and other organizations acting for business purposes.
Our services are not intended for consumers purchasing services for personal, household, or non-business purposes.
GoBeyondo reserves the right to refuse or cancel a service request if the Client does not qualify as a business client.
2. Our Services
GoBeyondo provides digital marketing and online presence services, which may include:

  • creation and development of business accounts and profiles on online platforms;
  • management and maintenance of business accounts and profiles;
  • optimization of websites and online presence for search engines, AI agents, and other automated systems;
  • listing and management of company information in directories, catalogs, marketplaces, and other public or industry-specific platforms;
  • planning and support of advertising campaigns; and
  • other digital marketing and online presence services agreed with the Client.

The exact scope of services provided to a Client will be determined individually for each project.
3. No Fixed Pricing
GoBeyondo does not publish fixed prices for its services.
Each project is individually assessed based on factors including, but not limited to:

  • the Client's requirements;
  • the scope of work;
  • the complexity of the project;
  • the number of platforms involved;
  • the amount of content and information to be processed;
  • the expected duration of the project; and
  • other requirements relevant to the particular engagement.

Following an initial inquiry, GoBeyondo will review the Client's requirements and provide an individual quotation or proposal.
A quotation does not constitute an obligation to provide services unless and until the Client accepts the applicable terms and GoBeyondo confirms the engagement.
The final price will be agreed with the Client before the services begin.
4. Service Agreement and Order Confirmation
Price and other material terms may be agreed through email or other written electronic communication or other written agreement.
Where a separate agreement is executed between GoBeyondo and the Client, that agreement will govern the specific project. These Terms will apply to the extent they are not expressly replaced or modified by the applicable agreement.
5. Payment
Unless otherwise agreed in writing, 100% of the agreed service fee is payable in advance.
GoBeyondo may accept payment through payment methods made available to the Client, which may include:

  • PayPal;
  • Stripe, where available;
  • bank transfer, where available.

The payment method available for a particular project may be specified in the applicable quotation or Order Confirmation.
GoBeyondo is not required to begin performing services until the required payment has been received and the project has been confirmed.
Any payment processing fees, currency conversion fees, bank charges, or similar charges imposed by third-party payment providers or financial institutions may be the responsibility of the Client unless otherwise agreed.
6. Service Commencement and Delivery
The general service process is:

  1. The Client contacts GoBeyondo;
  2. GoBeyondo reviews the Client's requirements and determines the proposed scope of work;
  3. GoBeyondo provides a quotation or proposal;
  4. The Client and GoBeyondo agree on the scope, price, and applicable terms;
  5. The Client makes the required 100% advance payment;
  6. GoBeyondo performs the agreed services; and
  7. GoBeyondo provides reports to the Client weekly or monthly, as agreed for the particular project.

The expected timing and delivery schedule may vary depending on the scope and nature of the services.
Unless expressly agreed otherwise in writing, GoBeyondo does not guarantee completion within a specific period where completion depends on third-party platforms, Client cooperation, availability of information, or other factors outside GoBeyondo's reasonable control.
7. Client Responsibilities
The Client agrees to:

  • provide accurate, complete, and up-to-date information reasonably required to perform the services;
  • provide necessary access credentials, permissions, materials, and approvals in a timely manner;
  • ensure that all information, content, trademarks, images, documents, and other materials supplied to GoBeyondo may lawfully be used for the purposes of the services;
  • promptly review and approve materials when approval is required; and
  • cooperate reasonably with GoBeyondo throughout the project.

GoBeyondo is not responsible for delays, additional costs, or unsuccessful results caused by inaccurate, incomplete, misleading, or delayed information supplied by the Client.
8. Third-Party Platforms and Services
Some services may involve third-party platforms, websites, directories, marketplaces, advertising networks, search engines, social networks, AI services, or other external providers.
GoBeyondo does not control these third parties and cannot guarantee:

  • approval or publication of an account, profile, listing, advertisement, or other submission;
  • continued availability of a third-party service;
  • continued publication of information;
  • specific search engine rankings;
  • inclusion in recommendations generated by AI systems;
  • specific traffic, leads, sales, conversions, or revenue;
  • changes to third-party algorithms, policies, requirements, or interfaces; or
  • the actions, decisions, or technical failures of third-party providers.

The Client acknowledges that third-party platforms may modify, restrict, suspend, or discontinue their services at any time.
9. Advertising and Marketing Results
GoBeyondo will perform agreed marketing services using reasonable skill and care.
However, unless expressly guaranteed in a separate written agreement, GoBeyondo does not guarantee any particular commercial result, including:

  • a specific number of leads;
  • sales or revenue;
  • website traffic;
  • advertising performance;
  • search engine ranking;
  • customer acquisition;
  • conversion rates;
  • AI recommendations;
  • any particular return on investment.

Marketing performance may depend on numerous factors outside GoBeyondo's control, including market conditions, competition, advertising platforms, algorithms, Client pricing, products, services, reputation, and customer behavior.
10. Reporting
GoBeyondo will provide reports concerning the services performed at the frequency agreed with the Client, which may be weekly or monthly.
Unless otherwise agreed, reporting will describe the work performed and relevant available results or activities.
Reporting does not constitute a guarantee of any particular business outcome. Reporting constitutes a confirmation of the amount of completed work that was pre-discussed before all the work starts.
11. Cancellation and Refunds
If the Client cancels an order before GoBeyondo has started performing the services, the Client may be eligible for a full refund.
If the Client cancels an order after work has started, GoBeyondo may determine the refund based on:

  • the portion of services already completed;
  • work already performed;
  • non-refundable third-party costs;
  • expenses incurred specifically for the Client's project; and
  • other reasonable costs directly associated with the project.

Any remaining refundable balance will be returned to the Client using the original payment method where reasonably possible.
Once the agreed services have been fully performed, no refund will be available for those services, except where required by applicable law or otherwise agreed in writing.
12. Termination of Ongoing Services
Where the parties have agreed to ongoing or recurring services, either party may terminate the engagement by providing 14 days' written notice, unless a different termination period is expressly agreed in a separate written agreement.
The Client remains responsible for amounts due for services performed and approved expenses incurred before the effective termination date.
13. Complaints and Claims
The Client should notify GoBeyondo of any complaint concerning the services within 14 days after completion of the relevant service.
The notice should reasonably describe the issue and provide sufficient information for GoBeyondo to investigate and, where appropriate, remedy the issue.
This provision does not exclude or restrict any rights or remedies that cannot lawfully be excluded or restricted under applicable law.
14. Intellectual Property
The Client retains all rights in materials, trademarks, logos, documents, content, data, and other intellectual property supplied by the Client.
Subject to full payment of all applicable fees, the Client will receive the rights to the final materials specifically created by GoBeyondo for the Client as part of the agreed project, to the extent and for the purposes agreed for that project.
Unless otherwise agreed in writing, GoBeyondo retains all rights in its:

  • methodologies;
  • processes;
  • know-how;
  • templates;
  • internal tools;
  • reusable components;
  • software and source code;
  • concepts and techniques;
  • preliminary materials; and
  • other materials not specifically created exclusively for the Client.

Third-party materials, including stock images, fonts, software, platform assets, plugins, and other licensed materials, remain subject to the applicable third-party licenses and terms.
15. Portfolio and Publicity
Unless otherwise agreed in writing, GoBeyondo may identify the Client as a client and describe the general nature of services provided for portfolio, marketing, or business development purposes.
GoBeyondo will not intentionally disclose confidential information for such purposes.
The Client may request in writing that GoBeyondo not use the Client's name or project for portfolio purposes.
16. Confidentiality
Each party agrees to keep confidential information received from the other party confidential and to use such information only for legitimate purposes related to the business relationship.
Confidential information may be disclosed where:

  • required by law or a competent authority;
  • necessary to provide the agreed services;
  • disclosed to professional advisers or service providers who are subject to appropriate confidentiality obligations; or
  • the information has become publicly available through no breach of these Terms.

The confidentiality obligations will continue after the termination of the business relationship.
17. Personal Data
GoBeyondo may process personal data in connection with the operation of its website and provision of services.
The processing of personal data is governed by GoBeyondo's Privacy Policy, as well as applicable data protection laws.
Where the Client provides personal data to GoBeyondo for processing on the Client's behalf, the Client represents that it has the necessary legal basis and permissions to provide such data and instruct GoBeyondo to process it.
18. Limitation of Liability
To the maximum extent permitted by applicable law, GoBeyondo's total aggregate liability arising out of or relating to a particular project or order will not exceed the total amount actually paid by the Client to GoBeyondo for the services giving rise to the claim.
To the maximum extent permitted by applicable law, GoBeyondo will not be liable for:

  • indirect or consequential losses;
  • loss of profits;
  • loss of revenue;
  • loss of business opportunities;
  • loss of customers;
  • loss of anticipated savings;
  • loss of data; or
  • other special or consequential damages.

GoBeyondo will not be liable for losses resulting from the acts, omissions, policies, decisions, technical failures, algorithm changes, suspension, termination, or unavailability of third-party platforms or services.
Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.
19. Force Majeure
GoBeyondo will not be responsible for failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control.
Such circumstances may include, without limitation:

  • internet or telecommunications failures;
  • cyber incidents;
  • platform outages;
  • changes or failures of third-party services;
  • governmental actions;
  • natural disasters;
  • war, armed conflict, civil unrest, or sanctions;
  • epidemics or pandemics;
  • power outages; or
  • other events beyond GoBeyondo's reasonable control.

20. Changes to These Terms
GoBeyondo may update these Terms from time to time.
The updated version will be published on the website with a revised "Last Updated" date.
Changes will not retroactively modify the material terms of a project that has already been agreed and paid for unless required by law or expressly agreed with the Client.
21. No Waiver
Failure by either party to enforce any provision of these Terms will not constitute a waiver of that provision or the right to enforce it later.
22. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
23. Governing Law and Dispute Resolution
These Terms and the relationship between GoBeyondo and the Client will be governed by the laws of Georgia, without regard to conflict-of-law principles.
The parties will first attempt in good faith to resolve any dispute through negotiations.
If the dispute cannot be resolved through negotiations, it will be submitted to the competent courts of Georgia, unless the parties agree otherwise in writing.
Nothing in this section prevents either party from exercising any mandatory rights or remedies available under applicable law.
24. Entire Agreement
These Terms, together with any applicable quotation, Service Agreement, Order Confirmation, or other written agreement between GoBeyondo and the Client, constitute the agreement between the parties concerning the relevant services.
If there is a conflict between these Terms and a specific written agreement signed or expressly accepted by both parties, the specific agreement will prevail with respect to that particular project.

26. Acceptance
By requesting, ordering, approving, or paying for GoBeyondo's services, the Client confirms that it has read, understood, and agreed to these Terms of Service and any additional terms applicable to the relevant project.
